District Permits Related Information

A project may also require a permit from other entities such as the MN Pollution Control Agency, Department of Natural Resources, Army Corps of Engineers, or other Local Municipality. More information on these agencies and their relationship to MCWD is provided below. OBTAIN ALL REQUIRED AUTHORIZATIONS FROM THE APPLICABLE AGENCIES BEFORE A PROJECT BEGINS.

Minnesota Pollution Control Agency (MPCA)

The MPCA requires that any construction activity that disturbs greater than one acre of land, or is part of a development that disturbs greater than one acre of land, must be covered under a National Pollutant Discharge Elimination System (NPDES) permit.

The Minnehaha Creek Watershed District (MCWD), through a Joint Powers Agreement, conducts NPDES inspections on behalf of the MPCA.

Department of Natural Resources (DNR)

The DNR requires permits for Dredging (Rule E), Stream and Lake Crossing (Rule G), and Shoreline and Streambank Improvement (Rule F) projects. However, through the DNR General Permit 2001-6009, the DNR has delegated permitting authority to the MCWD for a number of projects. If your project meets the conditions described in our rules, you should not need a separate permit from the DNR.
